Terms of Service

Draft. This page describes how the service works, but it has not been reviewed and the operating entity is not named yet. Do not treat it as final.

What you are buying

You are buying one email send. We take the listing details and photos you give us, lay them out in one of our templates, send you a proof, and after you approve it we send the email to agents in the market you chose, at the date and time you chose. That is the whole service. There is no account, no subscription and nothing that renews.

What we need from you

You supply the listing details, the photos, your contact information and your brokerage. By submitting them you confirm that you have the right to use them: that the photographs are yours or licensed to you, that the listing is one you are authorised to market, and that your name and brokerage are represented accurately.

We lay out what you send us. We do not verify listings, photographs or licensing, and we are not a party to any transaction that results.

The proof

Nothing sends until you approve the proof. If you do not approve it, nothing goes out. If you ask for a change before your send time, email hello@emailthemarket.com and we will make it.

What we do not promise

We tell you how many agents are on the market you picked, and we send to them. We do not promise a particular number of opens, clicks, replies, showings or sales, and no part of this service should be read as a promise about the outcome of your listing.

Email delivery is not something any sender controls end to end. An individual recipient's provider may filter, delay or reject a message for reasons outside our reach.

What you may not send

The service is for marketing a real property listing. You may not use it to send anything unlawful, anything deceptive about who you are or what you are offering, anything that infringes someone else's rights, or anything unrelated to a listing. We may decline to send material for any of these reasons and will tell you why.

Limits

Our liability for any claim arising out of a send is limited to the amount you paid for that send. Nothing here limits liability that cannot be limited by law.
